The Appellate Division of the Supreme Court has postponed the hearing of four applications made by BNP, Jamaat-e-Islami, five prominent citizens and one person to reconsider the verdict of canceling the caretaker government system.
On Sunday (March 2), the three-member Appellate Division led by Senior Justice Md. Ashfaqul Islam of the Appellate Division gave the order.
Attorney General was on the side of the state in the court. Asaduzzaman and Additional Attorney General Aneek R Haque, lawyer Barrister Ruhul Quddus Kajal and lawyer Mohammad Shishir Monir were in favor of the application.
It is to be noted that on February 11, the Appellate Division adjourned the hearing of four applications made by the political parties and six persons seeking a review of the cancellation of the caretaker government system.
The 13th Amendment to the Constitution was adopted by the National Parliament in 1996 by including the supervised government system in the constitution. In 1998, three lawyers, including Advocate M. Salim Ullah, filed a writ in the High Court, dismissing the writ and the supervisory system was declared legal.
The validity of this amendment was that the Supreme Court lawyer M Salimullah, along with others, filed a writ in the High Court in 1998. The High Court ruled on the preliminary hearing.
The 13th Amendment of the Constitution was granted on May 10, 2011 by the full bench of the Appellate Division, granting the appeal of the petitioner's side in 2005.
After the declared RACT, the 15th Amendment Act, which was brought into several poisons, including the abolition of the caretaker government system, was passed in the National Parliament on 30 June 2011. Later on July 3, 2011, the gazette was published.
After the change of government on August 5, five eminent persons including Badiul Alam Majumdar, Secretary of Citizens for Good Governance (Sujan) applied for reconsideration. The other four are Tofatael Ahmed, M Hafizuddin Khan, Zobairul Haque Bhuita and Zahra Rahman.
BNP Secretary General Mirza Fakhrul Islam Alamgir filed an application on October 16 in the Appellate Division.
Later, the resident of Naratanpa, Raninagar, Naogaon, brave freedom fighter Md. Mofazzal Hossain filed an application last year in the Appellate Division's REC Reconsideration.
